[미국] EPA, 「청정수질법」 수질 인증 지침 발표

미국 환경보호청(EPA)은 트럼프 대통령의 지시에 따라 6월 7일 「청정수질법(Clean Water Act, CWA)」 제401조에 대한 안내를 발표했으며, 제401조 인증 과정을 명확히 하고 간소화하고 더 많은 투자와 확실성을 촉진하기 위한 권장사항을 제시했다. 지역의 수자원을 보호하는 동시에 국가 기반 시설 프로젝트를 수행한다.

행정 명령 13868, '에너지 인프라 및 경제성장 촉진(Promoting Energy Infrastructure and Economic Growth)'에서 EPA는 연방 허가기관 및 주 및 공인 지자체 당국에 대한 지침을 발행하여 이전 지침을 현대화하고 기존 CWA 401 조항 요구사항을 명확히 하도록 지시했다.

EPA의 '연방 정 기관, 주 및 지자체에 대한 청정 수칙 401 조항 인증 지침(Clean Water Act Section 401 Certification Guidance for Federal Agencies, States, and Authorized Tribes)'은 CWA 401 절 인증에 대한 다음과 같은 특정 영역에 대한 설명과 권장 사항을 제공한다.

EPA의 2010년 이전 중간 지침을 대체하는 EPA의 새로운 지침은 연방기관, 주 및 지자체에 대한 추가 권장사항을 제공하여 제40조1 인증 프로세스를 통해 조기 협업과 조정을 촉진키로 했다. 

또한 행정 명령 13868은 EPA에게 2019년 8월 8일까지 EUA의 CWA 401 조항을 현대화하는 새로운 규칙을 제안하도록 지시했다. CWA 401 조항의 인증을 명확히 하고 간소화하는 데 도움이 되는 규정을 제안하도록 지시했다. 

행정 명령은 2019년 4월 10일에 발표되었으므로 해당 기관은 주, 지자체 파트너와 공식 협의를 시작했으며, 이러한 규칙 제정 노력에 대한 연방 파트너와 연락을 취하고 공개서면을 통해 서면 제안 권고안을 발표했다. 기관은 제안된 규칙을 발행하기 전에 이러한 계약과 도표를 통해 받은 의견을 신중하게 검토하고 있다.

EPA Issues Guidance On Clean Water Act Water Quality Certification

As directed by President Trump, today the U.S. Environmental Protection Agency (EPA) released guidance on Section 401 of the Clean Water Act (CWA) that provides recommendations to clarify and streamline the 401 certification process and to promote greater investment in and certainty for national infrastructure projects while continuing to protect local water quality.

Under Executive Order 13868, “Promoting Energy Infrastructure and Economic Growth,” EPA was directed to issue guidance for federal permitting agencies and state and authorized tribal authorities to modernize previous guidance and clarify existing CWA Section 401 requirements.

EPA’s “Clean Water Act Section 401 Certification Guidance for Federal Agencies, States, and Authorized Tribes” provides clarification and recommendations on CWA Section 401 certifications in the following specific areas:

- Statutory and regulatory timelines for review and action on a CWA Section 401 certification;
- The appropriate scope of CWA Section 401 certification conditions; and
- Information within the scope of a state or authorized tribe’s CWA Section 401 review.

EPA’s new guidance, which replaces EPA’s prior interim guidance from 2010, also provides additional recommendations to federal agencies, states and authorized tribes to promote early collaboration and coordination through the 401 certification process.

Executive Order 13868 also directed EPA to propose new rules modernizing the agency’s CWA Section 401 implementing regulations by August 8, 2019. The agency intends to propose regulations that may help further clarify and streamline CWA Section 401 certifications. Since the Executive Order was issued on April 10, 2019, the agency has initiated formal consultations with its state, local, and tribal partners, as well as outreach with its federal partners on this rulemaking effort and invited written pre-proposal recommendations through a public docket. The agency is carefully reviewing the input received through these engagements and the docket prior to issuing a proposed rule.

Background

Section 401 of the CWA provides states and authorized tribes with an important tool to help protect water quality within their borders in collaboration with federal agencies.

 The rules governing this authority have not been updated in nearly 50 years. In addition, evolving case law and EPA’s outdated guidance have caused some confusion and resulted in delays in certain infrastructure projects with potentially significant national benefits.
