스콱신 아이랜드 원주민, 「청정수법」 프로그램 요청 … EPA 승인

미국 환경보호청(EPA)은 「청정수법」에 따라 수질기준과 인증 프로그램을 관리하기 위해 스콱신 회담(Squaxin Island) 원주민의 신청을 접수합니다. 이 승인으로, 원주민은 보호구역과 그에 해당하는 감시를 보면 모든 지표수를 관리하고 보호할 수 있는 「청정수법」권한을 지켜야 한다. 해당하는 광산은 보호 구역 밖에서 광산 땅으로 미국이 스콱신 전시 원주민에게 신탁한 전시를 포함한다. 워싱턴주 셸턴근처에 스콱신 서부의 보호구역과 신탁하는 하향주 셸턴근처에 있는 약 2천598에이커에 이른다.

케이시 식스킬러(Casey Sixkiller) EPA 지역 10 관리자는 "EPA는 물이 생명이라는 것을 알고 있다. EPA는 스콱신 아일랜드 원주민이 보호수질 기준을 개발하고 채택함에 따라 보호수질 기준을 개발하고 채택할 수 있도록 지원하기 위해 노력하고 있다"면서 "EPA는 스콱신 아일랜드 원주민이 수자원과 지역 사회의 건강을 관리하고 보호하기 위해 「청정수법」에 따른 중요한 규제 책임을 맡게 되어 기쁘다"고 말했다.

스콱신 섬 원주민은 2022년 8월 18일에 EPA에 「청정수법」 제303조(c) 수질기준 및 제401조 수질인증 프로그램에 대한 '주(州)와 유사한 방식으로 처리(TAS)'를 신청했다. EPA의 인도 환경 일반 지원 프로그램 보조금 기금은 「청정수법」에 따라 주(州)와 유사한 방식으로 처리를 위한 성공적인 준비와 제출을 위한 원주민의 노력을 지원했다.

EPA의 승인은 스콱신 아일랜드 원주민의 보호구역 및 신탁지 내의 모든 지표수에 대해 수질기준을 개발할 수 있도록 권한을 부여하고, 「청정수법」에서 허용된 수질기준이 'R'일 경우 해당 수질기준을 모두 충족함을 인증한다. EPA의 검토 및 승인을 받아야 한다. 원주민이 채택한 표준이 EPA에 의해 검토되고 승인된 후, 원주민은 스콱신 아일랜드 보호구역 및 신탁지 내의 모든 지표수에 대한 배출이 해당 표준을 준수함을 인증할 수 있다. 스팍신 섬 원주민은 이전에 1998년과 2000년에 각각 섹션 106(수질 오염 보호)과 섹션 319(논포인트 소스)의 다른 「청정수법」 프로그램에 대해 TAS 자격을 부여받았다.

Squaxin Island Tribe receives EPA approval to administer Clean Water Act programs on reservation and trust lands

 

The U.S. Environmental Protection Agency has approved the application from the Squaxin Island Tribe to administer the water quality standards and certification programs under the Clean Water Act. 

With this approval, the Tribe will assume Clean Water Act authority to manage and protect all surface waters within its reservation and trust lands. Trust lands include lands located outside of the reservation that are held in trust by the United States for the Squaxin Island Tribe. The Tribe’s reservation and trust lands collectively cover about 2,598 acres near Shelton, Washington. 

“We know that water is life. EPA is committed to supporting the Squaxin Island Tribe as they develop and adopt protective water quality standards for their reservation and trust lands,” said Casey Sixkiller, EPA Region 10 Regional Administrator. “We’re excited for the Squaxin Island Tribe to take on this important regulatory responsibility under the Clean Water Act to manage and protect their tribal water resources and the health of their community.” 

"The Squaxin Island Tribe – the People of the Water – is pleased that the EPA recognizes our capacity and commitment to implement water quality standards and certification programs,” said Kris Peters, Chairman of the Squaxin Island Tribe. “As stewards of the waters within our jurisdiction, we greatly appreciate this first step toward developing water quality standards that will protect the Tribe’s cultural and economic well-being and support sustainable fisheries. The Squaxin Island Tribe applied to EPA for “Treatment in a Similar Manner as a State” (TAS) for the Clean Water Act section 303(c) water quality standards and the section 401 water quality certification programs on August 18, 2022. EPA’s Indian Environmental General Assistance Program grant funding supported the Tribe’s efforts to prepare and submit their successful for Treatment in a Similar Manner as a State under the Clean Water Act. 

EPA’s approval authorizes the Squaxin Island Tribe to develop water quality standards – the regulatory foundation for protecting water quality – for all surface waters within the Tribe’s reservation and trust lands and certify that Clean Water Act-permitted discharges to those waters will meet all applicable water quality standards, once they are reviewed and approved by EPA. After tribally adopted standards are reviewed and approved by EPA, the Tribe will be able to certify that discharges comply with those standards for all surface waters within the Squaxin Island Reservation and trust lands. The Squaxin Island Tribe was previously granted TAS status for other Clean Water Act programs in 1998 and 2000: section 106 (Water Pollution Protection) and section 319 (Nonpoint Source), respectively.
