[미국] EPA, 물인프라 강화해 화학물질 배출 대비·공중보건 보호 위한 보호조치 발표

미국 환경보호청(EPA)은 위험한 화학 물질을 강, 호수 또는 기타 수역으로 저장하고 배출할 수 있는 시설로부터 지역 사회와 환경에 대한 새로운 보호 조치를 확정했다고 밝혔다.

이러한 보호 조치는 EPA가 최근 발표한 '화학 사고 방지 규칙에 의한 더 안전한 지역 사회(Safer Communities by Chemical Accident Prevention Rule)'를 기반으로 하며, 이 규칙은 화학 시설에서 발생하는 폭발 및 기타 사고로 인한 공기 중 방출을 방지하고 해결하기 위한 가장 강력한 안전 조항을 포함한다. 기후 변화는 위험한 화학 물질 방출의 위험을 과중시킬 수 있기 때문에 보호 조치가 위험을 평가하고 그러한 방출에 대해 계획하고 대응할 수 있는 시설을 요구하는 이유다. 보호조치 또한 역사적으로 많은 규제 시설이 이러한 지역 사회 내 또는 근처에 위치해 있었기 때문에 이미 오염으로 인해 과중한 부담을 지고 있는 지역 사회에 대한 보호를 강화한다.

클리포드 빌라(Clifford Villa) EPA 토지 및 비상 관리국 부구장은 "기후 변화가 기상 이변의 빈도와 심각성을 증가시킴에 따라 이러한 사고에 대한 계획과 준비가 특히 중요하다"면서 "이러한 새로운 요구 사항은 특히 산업 시설과 불균형적으로 가까운 곳에 위치한 환경 정의 문제가 있는 지역 사회에서 시설이 위험 물질의 최악의 경우 배출을 계획하고 대응할 수 있도록 보장함으로써 환경과 지역 사회를 보호하는 데 도움이 될 것"이라고 말했다.

이러한 대응 계획은 시설이 최악의 경우 위험 물질 배출에 대응할 수 있도록 준비되어 있는지 확인하는 중요한 도구다. 최종 규칙은 위험 평가, 인력 역할 및 책임, 대응 조치, 훈련 및 연습을 포함한 다양한 구성 요소를 대응 계획에 포함하도록 요구한다.

EPA는 약 5천400개의 시설이 시설 대응 계획을 제출하기 위한 기준을 충족할 것으로 예상하고 있다. 또한 최종 규칙은 EPA 지역 관리자가 시설을 사례별로 평가하고, 해당하는 경우 시설이 환경 정의 우려가 있는 지역 사회에 미칠 수 있는 영향과 관련된 우려를 기반으로 대응 계획을 수립하도록 요구하는 프로세스를 제공한다.

최종 규칙 개발 시 EPA는 120일의 공개 의견 기간 동안 받은 의견을 고려했다. 최종 규칙은 제안된 기준을 수정해 환경에 실질적인 해를 끼칠 수 있는 시설을 보다 포괄적으로 선별하기 위해 현장의 「청정수법(CWA)」 유해 물질의 임계량을 낮췄다.

규제를 받는 시설은 규칙의 발효일로부터 36개월 이내에 EPA에 대응 계획을 제출해야 한다. 이 기간 동안, 해당 기관은 규제를 받는 지역 사회에 아웃리치를 수행하고 규정 준수 지원을 제공하며 요구 사항을 이해하는 데 도움이 되는 조직을 구현하는 데 전념할 계획이다.

EPA requires industrial facilities to enhance preparation for chemical discharges to water in adverse weather conditions, better protecting the environment and public health

 

Today, March 21, the U.S. Environmental Protection Agency finalized new safeguards for communities and the environment from facilities that store and could discharge dangerous chemicals into a river, lake, or other waterbody. These protections build on EPA's recent issuance of the "Safer Communities by Chemical Accident Prevention Rule," which contains the strongest ever safety provisions to prevent and address explosions and other accidental airborne releases from chemical facilities. The science is clear: climate change can supercharge the risks of dangerous chemical releases. That is why both actions require facilities to evaluate those risks and to plan for and respond to such releases. Both actions also strengthen protections for communities already overburdened by pollution because many regulated facilities have historically been located in or near these communities.

“As climate change increases the frequency and severity of extreme weather events, planning and preparedness for these incidents are especially important,” said Clifford Villa, EPA Deputy Assistant Administrator for the Office of Land and Emergency Management. “These new requirements will help protect the environment and communities by ensuring that facilities have planned for and can respond to worst-case discharges of hazardous substances, particularly in communities with environmental justice concerns, which are disproportionately located in proximity to industrial facilities.”

These response plans are an important tool to ensure facilities are prepared to respond to a worst-case discharge of hazardous substances. The final rule requires various components to be included in the response plans, including hazard evaluation, personnel roles and responsibilities, response actions, and drills and exercises.

EPA anticipates that approximately 5,400 facilities will meet the criteria to submit a facility response plan. Additionally, the final rule provides a process for EPA Regional Administrators to assess facilities on a case-by-case basis and, if appropriate, to require a facility to develop a response plan based on, among other things, concerns related to potential impacts of a worst-case discharge on communities with environmental justice concerns. 

In developing the final rule, EPA considered input received during the 120-day public comment period. The final rule revised the proposed criteria to lower the threshold quantity of Clean Water Act hazardous substances on site to more comprehensively screen for facilities that could cause substantial harm to the environment. 

Regulated facilities are required to submit response plans to EPA within 36 months of the effective date of the rule. During this time, the agency is committed to conducting outreach and providing compliance assistance to the regulated community and implementing organizations to help them understand the requirements.
