RESIDENTS SUE CITY OVER TIERED WATER RATES IN HILLSBOROUGH, CA.

Residents in the town of Hillsborough, Ca., have filed a lawsuit calling the town's application of water rates are unconstitutional. The town applies higher water rates for those residents who use more water, a practice known as tiered rates.

Nine residents are suing the town in an attempt to lower prices and recoup their payments, according to the San Francisco Chronicle.

The lawsuit alleges that higher water rates are not being applied fairly based on usage, and that the billing rates do not correlate with the actual cost of water service in the area.

California's Proposition 218 states that public agencies cannot charge more for a service than what it costs them to provide that service. The town says that their rate policies are constitutional, as cost for delivery go up with consumption.
